6. Who We Share Your Data With

Data may only be passed on to third parties if this is necessary for the purposes described in this Privacy Policy, if it is required by law, if you have given your consent, or if processors on our behalf have contractually undertaken to comply with the requirements of applicable data protection laws.

Progressive Automations is headquartered in Canada. A data transfer to countries outside the EU/EEA (so-called third countries) takes place only when necessary, required by law, or when you have given us your consent.

Canada has been recognized by the European Commission as providing an adequate level of data protection. For transfers to the United States or other countries without an adequacy decision, we ensure appropriate safeguards are in place. When service providers in third countries are used, in addition to written instructions, they are also bound by the agreement of the EU Standard Contractual Clauses (SCCs) on compliance with the level of data protection in Europe.

8. Data Retention

We retain your personal data only for as long as is reasonably necessary for the purpose for which it was collected and never longer than prescribed by applicable law. In some cases, we may have to store data longer than necessary for the original purpose to comply with legal requirements on retention.

Our standard retention periods are:

Order and Transaction Data: 7 years from the transaction date, as required for tax and legal compliance.

Customer Account Data: Duration of your account plus 2 years after account closure.

Marketing Consent Records: Until you withdraw your consent, plus 1 year for compliance documentation.

Customer Support Records: 3 years from the date of resolution.

Website Analytics Data: 26 months, after which data is anonymized or deleted.

In some cases, we will keep data in an anonymized form for statistical purposes rather than deleting it.

You have the right to demand from us erasure of your personal data without undue delay, and we are obliged to immediately erase this data if any of the reasons pursuant to Art. 17(1) GDPR applies. This is also known as the "right to be forgotten." The right to erasure does not apply in cases where we are legally required to retain data.

9.4 Right to Restrict Processing (Art. 18 GDPR)

You have the right to request that we limit how we use your personal data in certain circumstances, such as while we verify the accuracy of your data or assess a request to erase your data.

9.5 Right to Data Portability (Art. 20 GDPR)

You have the right to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format, and you have the right to transmit this data to another controller without hindrance.

9.6 Right to Object (Art. 21 GDPR)

You have the right to object at any time to the processing of your personal data that is based on legitimate interests or for direct marketing purposes. If you object to processing for direct marketing, we will stop processing your data for that purpose immediately.

9.7 Right to Withdraw Consent (Art. 7 GDPR)

If you have provided your consent for any processing of personal data, you may withdraw this consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing before your withdrawal.

9.8 Right to Lodge a Complaint

To exercise any of these rights, please contact us at privacy@progressiveautomations.com. We will respond to your request within 30 days. If we need additional time (up to 60 additional days for complex requests), we will inform you of the reason and extension period.

10. Profiling and Automated Decision-Making

We do not use fully automated decision-making pursuant to Art. 22 GDPR. Progressive Automations basically does not use "profiling" that produces legal effects or similarly significantly affects you.

We may use profiling to provide you with personalized content and advertising. If we use profiling in individual cases that may significantly affect you, we will inform you about this separately and, if necessary, obtain your prior consent.

11. Cookies and Tracking Technologies

Progressive Automations Inc. ("us", "we", or "our") produces electric linear actuators, compatible power supplies, and control systems to provide our customers with state-of-art linear motion products.

This Privacy Notice applies to the Progressive Motion mobile application, which is owned and operated by Progressive Automations and describes our policies and practices concerning the application usage.

The Privacy Notice does not address the privacy practices of Google Android or any third parties that we do not own or control.

As the Progressive Motion app's developer, we neither collect nor share any data from the app with third parties. We do not use links to third-party apps, websites, and resources either. A customer has a right to refuse and use the "Search Device Nearby" feature. Also, the Progressive Motion app requests access to use GPS.

The Progressive Motion application is not designed to be used by children under the age of 13. Therefore, children under 13 are required to use the app only supervised by adults.

If you wish to discontinue the use of the Progressive Motion app, simply stop using it and delete the app from your device. Please note that once the app is deleted, all permissions will also be removed and will have to be re-approved if you re-download the app.

This Privacy Notice is effective as of the date stated above. We reserve the right to update our app and reflect the changes in this notice accordingly.

The Progressive Motion app is free and will remain free indefinitely.
